Prime Minister Narendra Modi recently highlighted India’s unwavering commitment to empowering persons with disabilities, citing the historic passage of the Rights of Persons with Disabilities Act of 2016 as a significant milestone. This legislation reflects a paradigm shift in the nation’s approach to disability rights, reinforcing the principles of equality, dignity, and inclusivity.

The 2016 Act, which replaced the earlier Persons with Disabilities Act of 1995, aligns with the United Nations Convention on the Rights of Persons with Disabilities (UNCRPD). It broadens the definition of disability, recognizing 21 conditions, including autism, cerebral palsy, and multiple sclerosis. This expanded scope ensures that more individuals can access the benefits and protections they rightfully deserve.

Key Provisions of the 2016 Act

  1. Increased Reservations: The Act increases the reservation for persons with disabilities in government jobs and educational institutions from 3% to 4%.
  2. Stronger Penalties: It introduces stricter penalties for violations of the Act, including discrimination and exploitation.
  3. Accessibility Standards: The law mandates the implementation of accessibility standards in public buildings, transportation, and information and communication technology (ICT).
  4. Inclusive Education and Employment: Provisions focus on inclusive education and the promotion of vocational training to enhance employment opportunities.

PM Modi emphasized that the government’s commitment extends beyond legislation. Numerous initiatives, such as the Accessible India Campaign (Sugamya Bharat Abhiyan), are aimed at creating an inclusive environment where persons with disabilities can lead empowered and independent lives.
